DMCA Copyright Policy

Kultive.fun respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we respond to valid takedown notices for copyright infringement and terminate the accounts of repeat infringers.

1. Filing a DMCA takedown notice

If you believe content on Kultive.fun infringes your copyright, send a written notice to our Designated Agent (below). Your notice must include all of the following — incomplete notices will not be processed:

  1. A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf
  2. Identification of the copyrighted work you claim has been infringed (a description, or a URL to the original)
  3. Identification of the material that is claimed to be infringing — specifically, the full URL(s) of the content on Kultive.fun you want removed
  4. Your contact information: full legal name, mailing address, telephone number, and email address
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in your notice is accurate, and that you are the copyright owner or authorized to act on their behalf
Warning: Knowingly submitting false or misleading DMCA notices may expose you to liability under 17 U.S.C. § 512(f), including damages, attorney's fees, and court costs.

2. Designated Agent

We respond to valid notices within 5–10 business days. Content will be removed or disabled pending resolution.

3. Counter-notice procedure

If you believe your content was removed in error, you may submit a counter-notice. Your counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and its original location (URL)
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification
  4. Your full legal name, mailing address, and telephone number
  5. A statement consenting to the jurisdiction of the federal court in the district where you are located (or, if outside the United States, in any judicial district where Kultive.fun may be found), and that you will accept service of process from the person who submitted the original notice

Upon receiving a valid counter-notice, we will forward it to the original complainant. If they do not file a court action within 10–14 business days, we may restore the content.

4. Repeat infringer policy

Kultive.fun maintains a strict repeat-infringer policy:

Strikes expire after 12 months of good standing. We reserve the right to terminate accounts earlier in cases of blatant or large-scale infringement.

5. Fraudulent or abusive notices

Creators and subscribers who abuse the DMCA process — for example, by filing fraudulent notices to harass legitimate users — may have their accounts suspended or terminated. We cooperate with law enforcement in cases of abuse.
