Terms of Service
These Terms of Service ("Terms") govern your access to and use of Kultive.fun (the "Platform", "we", "us"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1. Eligibility
- You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is higher).
- You must provide accurate, complete, and current information when registering.
- You are responsible for all activity under your account. Keep your password secure and do not share it.
- One person, one account. Multiple accounts per user are prohibited without prior approval.
2. Accounts and roles
Kultive.fun offers two primary account types:
- Subscriber — browse and subscribe to creators, access purchased content.
- Creator — publish original content, monetize subscriptions and tips. Creators must complete identity and age verification before publishing.
3. Content rules
By uploading content, you represent and warrant that:
- You own the content or have full rights to use and distribute it.
- All depicted persons are at least 18 years old and have provided documented consent.
- The content does not violate any law or the rights of any third party.
- You have all records required under 18 U.S.C. § 2257 (see 2257 Statement).
4. Intellectual property
4.1 Your content
You retain ownership of all content you upload. By uploading, you grant Kultive.fun a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content solely for the purpose of operating and promoting the Platform.
4.2 Our content
The Kultive.fun name, logo, design, software, and all Platform-generated materials are owned by us or our licensors and are protected by copyright, trademark, and other laws.
5. Subscriptions and payments
- Subscriptions are billed on a recurring monthly basis unless cancelled.
- You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.
- All fees are non-refundable except where required by law or explicitly stated.
- Chargebacks result in account suspension pending review.
- Creators receive payouts after a platform fee. Current fee structure is available in the Creator Dashboard.
- Payment processing is handled by third-party providers. Your payment information is not stored on our servers.
6. Prohibited conduct
You agree not to:
- Violate our Content Policy
- Impersonate any person or misrepresent your identity
- Download, copy, scrape, or redistribute other users' content outside the Platform
- Attempt to circumvent paywalls or access restrictions
- Use automated tools (bots, scrapers) without written permission
- Harass, threaten, or stalk other users
- Interfere with or disrupt the Platform's operation
- Use the Platform for any illegal purpose
7. Termination
We may suspend or terminate your account at any time for violation of these Terms, suspected illegal activity, or to comply with a legal obligation. Upon termination:
- Your access to the Platform ends immediately
- Pending payouts may be withheld pending investigation
- For zero-tolerance violations, funds are forfeited and data is preserved for law enforcement

8. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted access, freedom from errors, or any specific result from using the Platform.
9. Limitation of liability
To the fullest extent permitted by law, Kultive.fun and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Platform. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold Kultive.fun harmless from any claim, loss, or damage arising from your use of the Platform, your content, or your violation of these Terms.
11. Governing law and disputes
These Terms are governed by the laws of the jurisdiction where Kultive.fun is registered, without regard to conflict-of-law principles. Any disputes shall be resolved through binding arbitration or the competent courts of that jurisdiction.
12. Changes
We may update these Terms from time to time. Material changes will be notified to registered users at least 14 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance.

Privacy Policy
This Privacy Policy explains how Kultive.fun ("we", "us") collects, uses, shares, and protects your personal data. By using the Platform, you consent to the practices described below.
1. Data we collect
1.1 Account data
- Email address, password (stored as a hash)
- Display name and avatar you choose
- For creators: identity and age verification documents, payout information
1.2 Content data
- Posts, images, videos, messages, and other material you upload
- Metadata (upload date, file type, size); EXIF data is stripped before publication
1.3 Payment data
- Handled entirely by third-party payment processors (e.g. CCBill, SegPay, crypto gateways). We do not store credit card or bank account numbers.
- We receive only transaction confirmations and masked card data (last four digits, card brand).
1.4 Usage data
- IP address, browser type, operating system, device identifiers
- Pages visited, time spent, referring URL
- Interaction events (clicks, subscriptions, likes) for analytics and fraud detection
1.5 Cookies & local storage
We use cookies, browser localStorage, and IndexedDB only for the purposes below. We do not use marketing or third-party advertising trackers, nor analytics that profile individual users.

You can clear all of this at any time via your browser settings, or in the app via Settings → Privacy → Manage cookies.
Analytics
We do not currently use any analytics cookies or third-party trackers. If we add analytics in the future, they will be opt-in and disabled by default.
You can manage your cookie preferences via the cookie banner shown on first visit, or by clearing your browser's storage at any time. Clearing storage will sign you out and reset your preferences. We do not use marketing/advertising cookies, third-party trackers, or analytics that profile individual users.
2. How we use your data
- To create and maintain your account
- To process payments and pay out creator earnings
- To moderate content and enforce our Content Policy
- To verify age and identity where required by law
- To detect and prevent fraud, abuse, and security incidents
- To respond to support requests and legal obligations
- To improve the Platform (aggregated, anonymized analytics)
- To send you transactional emails (account, billing). We do not send marketing emails without opt-in consent.
3. Who we share data with
- Payment processors — to complete transactions
- Identity verification providers — for age and ID checks
- Cloud hosting and CDN providers — to deliver the Platform (data encrypted in transit and at rest)
- Analytics providers — in aggregated, anonymized form
- Law enforcement — when compelled by valid legal process, or when content triggers mandatory reporting (e.g. CSAM → NCMEC)
We never sell your personal data to advertisers or data brokers.
4. Your rights
Depending on your jurisdiction (EU/EEA, UK, California, etc.), you have the following rights:
- Access — request a copy of the personal data we hold about you
- Correction — ask us to correct inaccurate data
- Deletion — ask us to delete your account and personal data
- Portability — receive your data in a machine-readable format
- Restriction / objection — limit how we use your data
- Withdraw consent — where processing is based on consent

5. Data retention
- Account data: retained while your account is active, plus up to 7 years after closure for legal and tax compliance
- Age/identity records: retained for at least 7 years (18 U.S.C. § 2257 requirement)
- Payment records: retained as required by financial regulation
- Backups: retained for up to 90 days after account deletion
- Records related to reported illegal content: retained as required by law and may be shared with authorities
6. Security
We use industry-standard measures including TLS encryption in transit, encryption at rest, hashed passwords, restricted access, regular audits, and 2FA for administrative accounts. No system is perfectly secure; we will notify affected users of any breach involving their data as required by law.
7. International transfers
Your data may be processed in countries outside your own, including the European Union, United Kingdom, and United States. Where required, we use Standard Contractual Clauses or other approved mechanisms to protect your data.
8. Changes to this policy
We may update this Privacy Policy as laws and practices evolve. Material changes will be announced at least 14 days before taking effect. Your continued use of the Platform constitutes acceptance.

Data Processing Agreement (DPA)
This Data Processing Agreement supplements our Privacy Policy and is provided to comply with Article 28 of the EU General Data Protection Regulation (GDPR) and equivalent provisions in the UK GDPR, Swiss DPA, and other applicable data protection laws.
1. Definitions
- "Data Controller" — Kultive.fun, which determines the purposes and means of processing personal data.
- "Data Subject" — you (the user or creator) whose personal data is processed.
- "Sub-processor" — any third party engaged by us to process personal data on our behalf.
- "Personal data" — any information relating to an identified or identifiable natural person.
2. Subject matter and duration
We process personal data on your behalf for the duration of your use of the Platform and any post-termination retention period specified in our Privacy Policy. The types of personal data and categories of data subjects are described in Section 1 of the Privacy Policy.
3. Sub-processors
We engage the following sub-processors. We notify users of any material changes to this list at least 14 days in advance:

4. International data transfers
Where personal data is transferred outside the European Economic Area (EEA) or UK, we rely on:
- Standard Contractual Clauses (SCCs) approved by the European Commission for transfers to sub-processors in the US (Google, Cloudflare).
- Adequacy decisions where the destination country has been recognised by the EU as providing adequate protection (e.g., UK, Switzerland).
- Supplementary technical measures — encryption in transit (TLS 1.2+) and at rest, restricted access controls, audit logging.
5. Security measures
- TLS 1.2+ encryption for all data in transit
- AES-256 encryption at rest (Firebase / Cloud Storage default)
- Hashed passwords using bcrypt or equivalent (Firebase Auth)
- Strict Firestore security rules with whitelist patterns and uid pinning
- Multi-factor authentication available for accounts (TOTP)
- Regular review of access logs and security rules
- Content Security Policy (CSP) headers to prevent XSS
- HSTS enforced for all connections
- Rate limiting on authentication and payment endpoints
6. Data subject rights (Articles 15–22 GDPR)
You can exercise the following rights at any time by contacting [email protected] or through Settings → Privacy in the app:
- Right of access (Art. 15) — download your data from Settings → Privacy → "Download my data"
- Right to rectification (Art. 16) — edit your profile and content in Settings
- Right to erasure (Art. 17) — delete your account from Settings → Account → "Delete account"
- Right to data portability (Art. 20) — receive your data in machine-readable JSON format
- Right to object / restrict processing (Art. 18, 21) — contact us by email
- Right to lodge a complaint with your local data protection authority (e.g., the EDPS in the EU)
We respond to verified requests within 30 days. We may extend this period by up to two months for complex requests with prior notice.
7. Data retention
- Active account data — retained while account is active
- After account deletion — personal data anonymised within 30 days; backups purged within 90 days
- Payment records — 7 years (legal requirement for tax compliance)
- Age verification records — 7 years (18 U.S.C. § 2257 requirement)
- Content moderation records (incl. CSAM reports) — as required by law and law enforcement
8. Breach notification
In the event of a personal data breach, we will notify the relevant supervisory authority within 72 hours where required by law. We will notify affected data subjects without undue delay when the breach is likely to result in a high risk to their rights and freedoms.

EU representative (Article 27 GDPR): not currently required as we do not regularly offer services to EU residents on a scale triggering Article 3(2). If our scale changes, we will appoint a representative and update this section.
Age & Children (COPPA / GDPR Article 8)
Kultive.fun is an adult platform strictly intended for users aged 18 and older. We do not knowingly collect personal data from minors.
1. Minimum age
- You must be at least 18 years old to create an account or use the Platform.
- Every visitor must confirm their age via the age-gate dialog before accessing any content.
- Creators must additionally provide age and identity verification before being approved (see 18 U.S.C. § 2257 section).
2. COPPA compliance (United States)
In accordance with the Children's Online Privacy Protection Act (COPPA, 15 U.S.C. § 6501–6506):
- We do not knowingly collect or solicit personal information from children under 13.
- If we become aware that a child under 13 has provided us with personal information, we will delete that information immediately and terminate the account.
- If you believe a child under 13 has provided personal information to us, please contact [email protected] — we will act within 24 hours.
3. GDPR Article 8 — children's data in the EU
Under Article 8 of the EU GDPR, processing of personal data of a child under 16 (or under the age set by each Member State, as low as 13) requires verifiable parental consent. Because our service is restricted to users 18+:
- We do not target children of any age.
- If a user under 16 attempts to register or is discovered using the Platform, the account will be terminated and personal data deleted within 24 hours of discovery.
- Parents or guardians who suspect their child has accessed the Platform may contact [email protected] to request immediate account deletion.
4. Age verification mechanisms
- For viewers — age-gate confirmation on first visit (currently self-declared; jurisdictional rules may require enhanced verification in future).
- For creators — ID-based verification (government-issued photo ID) before content monetisation is enabled, in compliance with 18 U.S.C. § 2257.
5. Reporting underage use
If you encounter content or behaviour that suggests a user may be a minor, report it immediately to [email protected]. We treat all such reports as the highest priority and will investigate within 24 hours.
6. CSAM (Child Sexual Abuse Material)
We have zero tolerance for child sexual abuse material. Any such content will be:
- Removed immediately upon discovery or report
- Preserved as required by law for evidentiary purposes
- Reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement
- The originating account terminated permanently with all related data retained for law enforcement

Content Policy
Kultive.fun is a platform for adult creators. We support creative and artistic expression for audiences aged 18 and over. At the same time, we have zero tolerance for illegal content. This policy explains what is allowed, what is strictly prohibited, and how our moderation process works.
Absolutely prohibited — zero tolerance
The following content is strictly forbidden on Kultive.fun. Uploading, sharing, requesting, or soliciting any of it will result in immediate account termination, technical measures to prevent re-registration, forfeiture of unpaid balances where permitted by law, and reporting to law enforcement:
- Child Sexual Abuse Material (CSAM). Any depiction of minors (under 18) in sexual, suggestive, or nude contexts — whether real, drawn, AI-generated, animated, or implied. No exceptions. Reports are filed with the National Center for Missing & Exploited Children (NCMEC) and relevant national authorities.
- Any sexual content involving minors, even if fictional, drawn, animated, or AI-generated. "Lolicon," "shotacon," and similar categories are banned without exception.
- Non-consensual content. Material involving unwilling participants, deepfakes of real people made without consent, revenge porn, hidden-camera footage, and stalking material.
- Bestiality / zoophilia. Any sexual content involving animals.
- Content depicting rape, incest, or sexual violence presented as genuine or endorsed.
- Human trafficking or any material that promotes, facilitates, or depicts it.
- Necrophilia or content sexualizing corpses.
- Terrorism, extremism, or violent content that incites real-world harm.
- Doxxing — sharing private, identifying information about any person without consent.
- Blood play.
- Strangulation / choking.
- Extreme BDSM with risk of serious injury.
- Intoxication fetish (alcohol, drugs).
- Hypnosis / mind-control presented as real.
- Coercion fantasies that reasonably appear to depict real, non-consensual events.
- Age-play styled to resemble minors.
Content depicting dangerous acts, severe injury, intoxication, or scenarios that reasonably appear non-consensual may be removed at Kultive.fun's discretion.
1. Who can use Kultive.fun
- You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to access or use this platform.
- All creators must verify their identity and age before publishing content.
- All performers appearing in any uploaded material must be at least 18 years old. Creators must retain age-verification records in accordance with 18 U.S.C. § 2257.
2. Allowed content
Kultive.fun permits adult content featuring consenting adults (18+) that complies with this Policy and all applicable laws.
Visual Content
- Original photography featuring verified adult performers.
- Adult video content featuring verified adult performers.
- Original illustrations, digital art, paintings, comics, and animations depicting clearly adult characters.
- Original 3D renders and CGI content depicting clearly adult characters.
- AI-generated content depicting clearly adult characters, provided it complies with all platform rules and is properly labeled.
- Cosplay, fantasy, science-fiction, and fictional character depictions involving clearly adult characters.
Written Content
- Adult fiction involving adult characters.
- Erotic stories and novels involving adult characters.
- Fantasy and science-fiction erotica involving adult characters.
- Adult roleplay content between consenting adults.
- Poetry and other literary works intended for adult audiences.
Educational and Informational Content
- Sexual wellness education.
- Relationship and intimacy education.
- Educational discussions of sexuality.
- Academic, artistic, and cultural discussion of adult themes.
- Behind-the-scenes creator content.
Consensual Adult Themes
The following themes may be permitted when all depicted participants are adults and the content clearly represents informed consent:
- Romantic and sexual relationships between adults.
- BDSM and kink content between consenting adults.
- Fetish content involving consenting adults.
- Nudity.
- Lingerie and glamour content.
- Erotic art and fantasy content.
- LGBTQ+ adult content.
- Solo content.
- Couple content.
- Group content involving consenting adults.
All fictional characters depicted in sexual content must be clearly represented as adults.
2.1 AI-generated content
- All AI-generated content must be clearly labelled as AI-generated.
- Using the likeness of any real person without their written consent is prohibited.
- Deepfakes of celebrities, influencers, or private individuals are prohibited.
- All characters must be clearly depicted and described as adults. We recommend characters read as 21+ to reduce ambiguity and moderation risk.
2.2 Derivative works & compilations
Kultive.fun allows the creation and publication of derivative works based on other creators' content, subject to the following conditions:
- The creator of a derivative work must credit the author(s) of the source content.
- Attribution must include the author's nickname and a link to their Kultive.fun profile, or a link to their official social media or other public pages.
- Removing or hiding attribution that is present in the source material is prohibited.
- The creator of a derivative work is responsible for respecting copyright and obtaining any permissions required by law or by the source content's terms of use.
- At a rights-holder's request, Kultive.fun may require proof of the right to use the material, or remove the disputed content.
Permitted types of derivative content include:
- HMV (Hentai Music Video) and similar music edits.
- PMV (Porn Music Video) and similar music edits.
- Best-of compilations and themed collections.
- Edits, remixes, and scene cuts.
- Trailers, teasers, and promotional clips.
- Reactions, reviews, and analytical content that uses content excerpts.
- Collaborative projects combining material from multiple creators.
Kultive.fun reserves the right to remove derivative content in case of a rights-holder complaint, copyright infringement, missing or improper attribution, or any other violation of this Policy.
3. Moderation process
3.1 Pre-publication review
Every image, video, and audio file uploaded to Kultive.fun enters a moderation queue. Moderators verify:
- All visible performers appear adult and match the creator's on-file documentation
- The content does not violate any prohibition listed above
- Metadata has been stripped of personally identifying information
- Hash-matching against PhotoDNA and similar databases returns no matches
3.2 Post-publication monitoring
Published content remains subject to review. Community reports, re-scans, and audits may trigger re-moderation at any time.
3.3 Appeals
If your content is rejected, you will receive a reason. You may appeal within 14 days by contacting [email protected]. Appeals involving prohibited categories (see "Zero tolerance" above) are not subject to reinstatement.
4. Reporting illegal content
If you encounter any content on Kultive.fun that appears to violate this policy — especially anything involving minors — report it immediately:

- For CSAM specifically, you may also report directly to NCMEC CyberTipline
We prioritize CSAM reports immediately and report apparent CSAM to the appropriate authorities without delay. All other reports are handled within 72 hours.
5. Enforcement
Violations are handled on a strict scale:
- Zero-tolerance violations (see above): immediate permanent account termination and technical measures to prevent re-registration; suspension, withholding, or forfeiture of unpaid balances where permitted by law and contractual obligations; preservation and disclosure of account data to law enforcement.
- Serious violations (e.g. undisclosed use of third-party content, deceptive age claims): account suspension, content removal, loss of monetization.
- Minor violations (e.g. mis-tagged content, formatting issues): warning, content adjustment required.
Kultive.fun reserves the right to remove any content that poses legal, reputational, payment-processing, or safety risks, even if not explicitly listed in this policy.
6. DMCA and intellectual property
Kultive.fun respects intellectual property rights. If you believe content on this site infringes your copyright, see our DMCA Policy for how to file a takedown notice.
7. Changes to this policy
We may update this policy as the platform grows and as legal requirements evolve. Material changes will be announced to all registered users at least 14 days before taking effect.

DMCA Copyright Policy
Kultive.fun respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we respond to valid takedown notices for copyright infringement and terminate the accounts of repeat infringers.
1. Filing a DMCA takedown notice
If you believe content on Kultive.fun infringes your copyright, send a written notice to our Designated Agent (below). Your notice must include all of the following — incomplete notices will not be processed:
- A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf
- Identification of the copyrighted work you claim has been infringed (a description, or a URL to the original)
- Identification of the material that is claimed to be infringing — specifically, the full URL(s) of the content on Kultive.fun you want removed
- Your contact information: full legal name, mailing address, telephone number, and email address
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate, and that you are the copyright owner or authorized to act on their behalf

We respond to valid notices within 5–10 business days. Content will be removed or disabled pending resolution.
3. Counter-notice procedure
If you believe your content was removed in error, you may submit a counter-notice. Your counter-notice must include:
- Your physical or electronic signature
- Identification of the material that was removed and its original location (URL)
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification
- Your full legal name, mailing address, and telephone number
- A statement consenting to the jurisdiction of the federal court in the district where you are located (or, if outside the United States, in any judicial district where Kultive.fun may be found), and that you will accept service of process from the person who submitted the original notice

Upon receiving a valid counter-notice, we will forward it to the original complainant. If they do not file a court action within 10–14 business days, we may restore the content.
4. Repeat infringer policy
Kultive.fun maintains a strict repeat-infringer policy:
- First strike: warning and content removal
- Second strike: temporary suspension (14 days) and loss of monetization for the affected content
- Third strike: permanent account termination and forfeiture of pending payouts
Strikes expire after 12 months of good standing. We reserve the right to terminate accounts earlier in cases of blatant or large-scale infringement.
5. Fraudulent or abusive notices
Creators and subscribers who abuse the DMCA process — for example, by filing fraudulent notices to harass legitimate users — may have their accounts suspended or terminated. We cooperate with law enforcement in cases of abuse.

18 U.S.C. § 2257 Compliance Statement
All visual content appearing on Kultive.fun that depicts actual human sexually explicit conduct is in full compliance with the requirements of 18 U.S.C. § 2257, 28 C.F.R. § 75, and all related or analogous provisions of law.
1. Content covered
This statement applies to all visual depictions of actual sexually explicit conduct published on Kultive.fun, as those terms are defined in 18 U.S.C. § 2256.
Content consisting solely of original art (drawings, 3D renders, illustrations, AI-generated imagery of non-existent characters) depicts no real persons and is therefore not subject to § 2257. However, all such content is still required to depict only adult-appearing characters in accordance with our Content Policy.
2. Creator obligations
Creators who upload content depicting actual human performers are required to:
- Obtain and retain a legible copy of each performer's government-issued photo ID (passport, driver's license, national ID)
- Verify that each performer is at least 18 years old at the time of production
- Obtain signed model releases and consent forms for each production
- Retain all records for a minimum of 7 years and make them available to the Records Custodian on request
- Provide records to Kultive.fun upon request during moderation, investigation, or audit
Failure to provide valid age-verification records results in immediate content removal and account suspension pending review.
3. Records Custodian

4. Third-party content
Kultive.fun acts as a platform hosting content uploaded by independent creators. Creators are the primary producers of the content they upload and are individually responsible for § 2257 compliance. Kultive.fun, as a secondary producer, verifies that each creator has attested to compliance and has provided or can provide the required records.
5. Exempt material
Pursuant to 18 U.S.C. § 2257(h)(1), the following are exempt from § 2257 record-keeping requirements:
- Depictions of simulated (not actual) sexually explicit conduct
- Purely artistic, animated, drawn, or computer-generated content depicting no real persons
- Content produced before July 3, 1995, and not re-released
